Subject: Formal Dispute of Paid Repair Quotation of ?1,15,668 – Request for Written Clarification and Shield Extended Warranty Adjudication – Mahindra XUV300 PB10HW0691 Dear Sir/Madam, With reference to the proposed paid repair/replacement of the Exhaust After Treatment System (DPF) and associated components of my Mahindra XUV300 W8 OPT DS AMT BS6 E, Registration No. PB10HW0691, I hereby formally dispute the proposed chargeable repair and request that the matter be referred to and adjudicated by Mahindra & Mahindra Ltd. Customer Care / Shield Extended Warranty Department. Dada Motors has provided a quotation amounting to ?1,15,668, comprising replacement of the Exhaust After Treatment System/DPF, differential pressure sensor, temperature sensors, lambda sensors, associated pipes/gaskets and labour. However, before I authorise any paid replacement, I require Mahindra to provide a clear, reasoned and written determination of the Shield Extended Warranty applicability. As per Clause 2.2 – Coverage of the Shield Extended Warranty Terms & Conditions, where a defect is found during the Shield tenure, Mahindra’s obligation is to repair or replace a defective part at no cost for parts or labour where the defect is attributable to faulty material or workmanship at the time of manufacture. shield_terms_and_conditions.pdf Further, the Shield document specifically identifies certain maintenance/replacement items which are not covered. However, the Exhaust After Treatment System/DPF is not expressly identified as a maintenance replacement item in the Terms & Conditions document supplied to me. shield_terms_and_conditions.pdf Accordingly, I request Mahindra to clarify the following: Whether the Exhaust After Treatment System/DPF fitted in my vehicle is covered or excluded under my Shield Extended Warranty. If Mahindra considers the DPF/Exhaust After Treatment System or any of the associated sensors to be excluded, kindly provide the exact clause number and the applicable Master Schedule of Parts Covered/Not Covered relied upon for such exclusion. Kindly provide the complete technical diagnosis, including the relevant DTC/error codes, diagnostic findings and test results on the basis of which replacement of the complete Exhaust After Treatment System and associated sensors has been recommended. Kindly provide the technical root-cause analysis establishing why the proposed failure is being treated as a non-warranty failure rather than a defect potentially covered under Clause 2.2 of the Shield Extended Warranty. If Mahindra’s position is that the failure has resulted from improper/contaminated fuel, improper maintenance, non-recommended fluids, corrosion, external damage, misuse or any other specific exclusion, kindly state the precise factual and technical evidence supporting that conclusion and identify the corresponding clause of the Shield Terms & Conditions.
