Complaint regarding delivery of incorrect/incomplete food item and short refund by Zomato – Jodhpur Samosa Paav ordered from Jodhpur Namkeen, Kota

I placed an order through Zomato from Jodhpur Namkeen, Kota. One of the items ordered was specifically listed as “Jodhpur Samosa Paav”. However, instead of the ordered “Jodhpur Samosa Paav”, only a simple/plain samosa was delivered. Thus, the item supplied was not the item that I had ordered and paid for. I raised a complaint with Zomato regarding the incorrect/incomplete delivery. Zomato provided a refund of only ₹75 against the said item. However, the actual price/value of the ordered item was ₹90, and therefore the refund provided was short by ₹15. I consider this to be a deficiency in service and an inadequate refund for the incorrectly supplied item. Despite the issue being brought to the platform's notice, the complete amount of ₹90 was not refunded. I request the Hon’ble Consumer Commission to direct the opposite party/opposite parties to: 1. Refund the remaining ₹15 wrongly withheld from the amount payable for the affected item. 2. Provide appropriate compensation for the inconvenience and deficiency in service caused to me. 3. Reimburse reasonable litigation/complaint expenses incurred by me. 4. Grant any other relief deemed appropriate by the Hon’ble Commission. I am submitting the relevant order details, invoice/bill, screenshots of the ordered item, photographs/details of the item received, refund details and communications with Zomato as supporting documents.
