MOST RESPECTFULLY SHOWETH: 1. Transaction Details: I placed an order on the Opposite Party’s e-commerce platform (FirstCry) on 16th September 2026 for essential baby hygiene supplies, specifically baby diapers, vide Order ID: 36108002TGKAF8E474, for a total consideration of ₹ 656 paid via Phonepay. 2. Commitment of Next-Day Delivery: At the time of placing the order, the Opposite Party explicitly promised and represented guaranteed next-day delivery, scheduling the delivery date as 17th September 2026. Relying upon this specific representation, I purchased the product on the OP's platform instead of procuring it from an alternative offline vendor. 3. Deficiency in Service & Unilateral Delay: The ordered goods consist of baby diapers, which constitute essential infant daily care supplies where timely delivery is critical. Despite the explicit timeline, the product was not delivered on 17th September 2026. Upon checking the tracking status late on the night of 17th September, the I discovered a unilateral update stating the shipment had been delayed to 18th September 2026, without any prior intimation or consent. 4. Mental Agony and Hardship: Due to the unwarranted delay in delivering a time-sensitive infant essential, I faced severe inconvenience, distress, and was forced to make emergency arrangements to ensure the infant's hygiene and care. The Opposite Party's false commitment of next-day delivery constitutes an unfair trade practice under Section 2(47) and a clear deficiency in service under Section 2(11) of the Consumer Protection Act, 2019. 5. Cause of Action: The cause of action arose on 16th September 2026 when the order was booked with a committed delivery date, and subsequently on 17th September 2026 when the delivery window was breached without valid explanation. 6. Reliefs Prayed For: In light of the facts stated above, I respectfully prays that this Hon'ble Commission may be pleased to direct the Opposite Party to: Refund the delivery charges or full order value if not received satisfactorily; Pay a sum of ₹20,000 towards compensation for mental agony, hardship, and harassment caused due to the non-delivery of essential baby care items on the promised date; Pass any other order deemed fit and proper in the interest of justice.
