Power of Attorney for NRIs

A properly executed POA — drafted, attested abroad, registered in India.

Powers of Attorney Act + Registration Act, 1882 / 1908 · Attestation & adjudication requirements

Overview

Almost every NRI matter in India — selling property, fighting a case, managing a bank account, registering documents — runs on a Power of Attorney. Done wrong, it is rejected by the registrar or, worse, becomes an instrument of fraud. Done right, it is executed before the Indian Embassy/Consulate (or apostilled), sent to India, stamped and adjudicated within the statutory window, and drafted narrowly so the agent can do exactly what you intend and nothing more. We draft, guide the attestation, and complete the India-side registration.

Key Provisions — Powers of Attorney Act + Registration Act, 1882 / 1908

  • A POA executed abroad must be attested by the Indian Embassy/Consulate or notarised and apostilled (Hague Convention countries).
  • It must be stamped/adjudicated in India within 3 months of receipt to be usable before registrars and courts.
  • For sale of immovable property, registration of the POA is effectively mandatory and Supreme Court rules restrict general-POA sales.
  • Specific POAs (one transaction, named property, named agent) are safer than general POAs — and revocable at any time.

What You Can Get

A legally valid, registered POA
Safe drafting that limits agent powers
Revocation of a misused existing POA
End-to-end handling: draft → embassy → India registration

How We Handle It

Frequently Asked Questions

Can I sell my India property entirely through a POA?

Yes — a registered specific POA to a trusted person (commonly a family member) is the standard route; the sale deed is then registered normally.

I gave a general POA years ago and I'm worried it's being misused.

A POA is revocable: we execute and publish a revocation deed, notify the registrar and the agent, and pursue any misuse already done.
