Consumer Complaint – Request for Refund of ₹1,00,000 Paid for Paper Plate Machine I am Mrs. Binu P., and I purchased/booked a paper plate-making machine from Morningstar Enterprises. The machine was originally listed at a price of ₹3,60,000. However, the representatives of Morningstar Enterprises offered to provide the machine to us for ₹2,00,000, along with the following assurances: Free raw materials for making paper plates. Free transportation/shipping of the machine. The condition that the finished paper plate products would be supplied back to Morningstar Enterprises. They also assured us that they would arrange a loan through SBI to finance the purchase. Based on these representations and assurances, we agreed to purchase the machine. We initially paid ₹5,000 as an advance on [DATE]. It was agreed that the total price would be ₹2,00,000, of which ₹1,00,000 would be paid initially and the remaining ₹1,00,000 would be paid after the SBI loan was approved, which the seller had assured us they would arrange. On 24/08/2026, we were initially willing to pay ₹50,000 and pay the remaining ₹50,000 after the machine was delivered and installed at our home. However, the representatives of Morningstar Enterprises insisted that we pay the entire ₹1,00,000 in advance. Relying on their assurances, we paid ₹1,00,000 on 24/08/2026. However, at around 4:00 PM on the same day, after we had made the payment, we were informed that the machine was already lying with VRL Transport in Thiruvananthapuram and that we would have to pay another ₹1,00,000 before the machine would be handed over to us. This additional demand was not what we had understood or agreed to when we made the payment. We had neither been informed beforehand that we would have to pay another ₹1,00,000 to obtain the machine nor did we have the financial capacity to make such an additional payment. Since we were unable to pay the additional ₹1,00,000 and because the terms being demanded from us were different from what had been represented to us, we immediately requested cancellation of the transaction and a refund of the ₹1,00,000 already paid by us. The representatives informed us that they would look into the matter, reduce the applicable charges and arrange for the refund. However, despite our repeated requests, we have not received the refund and have not received the machine either. The machine has therefore never been delivered to us, and we have received no benefit or possession of the machine for the ₹1,00,000 paid by us. We subsequently received communication from Morningstar Enterprises stating that transportation, holding, return freight and other expenses may be deducted from the amount refundable to us. However, these additional charges were not clearly disclosed to us or agreed upon by us before we made the payment.
