Consumer Complaint Against DataMites and Bajaj Finance Regarding Disputed Agreement Acceptance, Lack of Informed Consent, Course Cancellation, and Related EMI

Complaint Regarding DataMites Course Enrollment, Disputed Agreement Acceptance, Cancellation and Associated Bajaj Finance EMI I am filing this complaint regarding my enrollment with DataMites and the subsequent finance/EMI arrangement through Bajaj Finance. I initially approached/enrolled with DataMites and paid the registration fee. At the time of registration, I was not provided with the course agreement for my proper review and understanding. I did not knowingly accept or sign the course agreement or its terms at the time of registration. After approximately four days from the date of my registration/payment, the course agreement was sent to my email. I dispute that I personally and knowingly accepted the agreement before or at the time of registration. The agreement was handled/sent through the agent, and I was not given a proper opportunity to review and understand the contractual terms before proceeding. I therefore request DataMites to produce the complete original agreement and the complete digital acceptance/signature audit trail, including the date and time of acceptance, method of acceptance, OTP/e-sign records, email/mobile details used for acceptance, and any other evidence establishing that I personally and knowingly accepted the agreement. I subsequently decided not to continue with the course and communicated my request for cancellation. I have attempted to resolve the matter directly with the institute, but I have not received a satisfactory resolution. A Bajaj Finance EMI/loan arrangement is also connected with this enrollment. I dispute the manner in which the finance arrangement was presented/authorized and request that Bajaj Finance provide the complete loan documentation, Key Facts Statement where applicable, consent/acceptance records, OTP/e-sign records, disbursement details, and evidence establishing that I knowingly authorized the finance arrangement. My grievance is not merely that I changed my mind about attending the course. My primary concern is the manner in which the agreement and associated finance arrangement were created and accepted, the lack of a proper opportunity to review the contractual terms before enrollment, and the absence of clear and informed consent as alleged by the opposite parties. I request the Hon'ble Consumer Commission to examine the complete transaction, communications, agreement, acceptance records and finance documents and determine the appropriate relief under applicable consumer law. Relief Requested I respectfully request the Hon'ble Commission to: 1. Direct the opposite parties to provide the complete records and evidence relating to my alleged acceptance of the course agreement and finance arrangement. 2. Consider my request for cancellation of the DataMites course enrollment. 3. Consider appropriate refund of amounts found payable to me after examining the transaction and applicable terms. 4.
